Use of the Website

You agree to use this Website only for lawful purposes. You may not misuse the Website, attempt unauthorized access, interfere with its operation, or use the Website in any manner that could harm Mar Beaux Arts or other users.

Service Requests and Bookings

Submitting an inquiry or booking request does not automatically guarantee acceptance of a project or event date.

All services are subject to availability, scheduling, project scope, location, and written confirmation by Mar Beaux Arts.

A booking is only considered confirmed once it has been accepted in writing and any required retainer, deposit, or initial payment has been received.

Quotes and Pricing

All quotes, estimates, and pricing information are subject to change until the booking or commission is confirmed in writing.

Pricing may vary depending on project scope, artwork size, materials, complexity, event duration, travel requirements, venue logistics, rush requests, and any special requirements.

Deposits and Payments

Mar Beaux Arts may require a non-refundable retainer or deposit to reserve a commission slot, event date, or service appointment.

Unless otherwise agreed in writing, no project or event date is reserved until the required payment has been received.

If a payment schedule is agreed upon, payments must be made on time. Failure to make payment may result in delays, suspension, cancellation, or release of the reserved date or project slot.

Cancellations and Rescheduling

If you need to cancel or reschedule, you must provide written notice as soon as possible.

Retainers and deposits are generally non-refundable unless otherwise agreed in writing.

If rescheduling is possible, previously paid amounts may be applied to a new date at the sole discretion of Mar Beaux Arts and subject to availability.

If substantial planning, design work, preparation, or material purchasing has already begun, Mar Beaux Arts reserves the right to retain amounts already paid and charge for work already completed and non-recoverable costs.

Commissions and Custom Artwork

All commissioned artwork is custom and may involve artistic interpretation.

By requesting a commission, you acknowledge that Mar Beaux Arts retains artistic discretion regarding style, composition, brushwork, color treatment, and overall execution, while making reasonable efforts to honor the agreed concept and specifications.

Minor revisions may be offered at the discretion of Mar Beaux Arts. Significant changes, repeated revisions, or changes outside the original scope may require additional fees and additional time.

Mar Beaux Arts reserves the right to decline any commission request for any lawful reason.

Event Services

For live wedding painting, face painting, and other event-based services, the client is responsible for providing accurate event details, including date, time, location, venue access, setup conditions, parking information, and a safe and suitable working environment.

Delays or limitations caused by inaccurate information, venue restrictions, lack of access, unsafe conditions, weather, or other circumstances beyond reasonable control may affect performance or delivery.

For events involving children or guest participation, the client is responsible for obtaining any necessary permissions, approvals, and supervision.

Travel and Additional Costs

Services may be subject to additional costs, including travel fees, parking fees, lodging, shipping, rush fees, taxes, venue-related expenses, or material surcharges where applicable.

Any such costs will be communicated before final confirmation whenever reasonably possible.

Delivery and Completion

Estimated delivery or completion dates are approximate unless expressly confirmed in writing.

Mar Beaux Arts is not responsible for delays caused by shipping carriers, weather, venue issues, illness, emergencies, supply shortages, or other circumstances beyond reasonable control.

Refunds

Because many services involve custom, artistic, time-sensitive, or event-specific work, refunds are not guaranteed.

Payments made for completed work, time reserved, creative development, or purchased materials are generally non-refundable unless otherwise required by law or expressly agreed in writing.

Intellectual Property

All content made available through the Website and Services, including but not limited to the website design, layout, artwork, paintings, images, graphics, logos, trademarks, service marks, trade names, and branding elements, is and remains the exclusive property of Mar Beaux Arts or its licensors and is protected by applicable intellectual property laws.

You do not acquire any ownership rights in the Website content or branding by using the Website or Services.

Unless otherwise agreed in writing, Mar Beaux Arts retains all copyright and reproduction rights in commissioned and created artwork, including sketches, drafts, and final works.

Portfolio and Promotional Use

Unless otherwise agreed in writing, Mar Beaux Arts may photograph, display, publish, or otherwise use completed artwork, commissioned work, and event-related artistic output for portfolio, website, exhibition, editorial, social media, and promotional purposes.

If confidentiality or delayed publication is required, this must be agreed in writing in advance.

Third-Party Links and Collaborators

The Website may contain links to third-party websites, collaborators, venues, wedding professionals, or service providers.

These third parties operate independently, and Mar Beaux Arts is not responsible for their content, services, policies, or performance.

User Submissions

If you provide messages, testimonials, photos, inspiration materials, reference images, feedback, or other content, you confirm that you have the right to provide them and that they do not infringe the rights of any third party.

You grant Mar Beaux Arts a limited right to use such materials as reasonably necessary to review, prepare, and perform the requested Services.

Mar Beaux Arts makes no guarantee that the Website will always be available, uninterrupted, or error-free.

Artistic services are inherently subjective, and while services will be performed in good faith and with professional care, no guarantee is made that artistic outcomes will match personal preferences beyond the scope specifically agreed in writing.

Limitation of Liability

To the fullest extent permitted by law, Mar Beaux Arts shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to the Website or Services.

To the extent permitted by law, total liability shall not exceed the total amount actually paid for the specific service giving rise to the claim.

Force Majeure

Mar Beaux Arts shall not be liable for any delay or failure in performance caused by circumstances beyond reasonable control, including illness, severe weather, natural disaster, transportation disruption, venue closure, equipment failure, internet outage, governmental action, or other force majeure events.

Consumer Rights

Nothing in these Terms is intended to limit any non-waivable rights available under applicable law.

Governing Law

These Terms shall be governed by the laws of the State of Louisiana, without regard to conflict of law principles.

Dispute Resolution

Before initiating formal legal proceedings, the parties agree to attempt to resolve any dispute in good faith through written notice and informal discussion.

Any legal action arising out of or relating to these Terms or the Services shall be brought in the appropriate courts located in Louisiana.

Changes to These Terms

Mar Beaux Arts may update these Terms from time to time. Any updates will be posted on this page with a revised “Last updated” date.
